Reform Index 136: Nuclear Energy Regulation And School Education Deregulation

Reform Index is +0,6 points for the period from 1st of June, 2020 to 14th of June, 2020 out of possible range from -5,0 to +5,0. The index for the previous round was also +0,6 points.

Law on bringing the nuclear and radiation safety in accordance with the international standards, +1,0 points

Back in 2016, the Parliament has passed the law which among other things allowed to liberalize nuclear energy control and supervision. These clauses violated the independence of the state regulatory body for nuclear and radiation safety. It contradicted the legislation on licensing activities in the field of nuclear energy and a number of Ukraine’s international obligations.

Law #613-IX solved this problem and harmonized the legislation on state supervision with the norms on supervision in the field of nuclear energy.

Certification for providers of compulsory documentation for schools has been abolished, +1.0 points

Providers of compulsory business documentation for schools are no longer required to have a special certificate of compliance with pedagogical requirements. These changes were made by the order #725 of the Ministry of Education and Science of Ukraine of June 1, 2020. A more detailed explanation was included in the letter #1/9-295 of June 2, 2020.

Until now, only those tender participants who have received a certificate “Use in educational institutions of Ukraine is allowed” from the Institute for modernization of the content of education could participate in the relevant procurement procedures. The submission of certificates of compliance with pedagogical requirements by bidders does not provide any competitive advantages when procuring mandatory business documents for schools at the expense of state and local budgets.
